Formation sanctionnée par le Certificat National de Compétences – Niveau V – RS5622
En 2024, l’ERTS a obtenu 100 % de réussite au Certificat !
– arrêté du 2 janvier 2009 (JORF n°0012 du 15 janvier 2009) relatif à la formation complémentaire préparant aux certificats nationaux de compétence de mandataire judiciaire à la protection des majeurs et de délégué aux prestations familiales.
– décret n° 2008-1508 du 30 décembre 2008 (JORF n°0304 du 31 décembre 2008) relatif aux conditions d’âge, de formation et d’expérience professionnelle devant être satisfaites par les mandataires judiciaires à la protection des majeurs et par les délégués aux prestations familiales
– loi n° 2007-308 du 5 mars 2007 (JORF n°0056 du 7 mars 2007) portant réforme de la protection juridique des majeurs (articles 14 à 24)
Le Métier
La fonction de Mandataire Judiciaire à la Protection des Majeurs (MJPM) consiste à assurer, dans le strict respect du mandat du juge, une mesure de protection civile (sauvegarde de justice, curatelle ou tutelle) visant protéger « toute personne dans l’impossibilité de pourvoir seule à ses intérêts en raison d’une altération, médicalement constatée ».
Le mandataire exerce la mesure « destinée à la protection tant de la personne que des intérêts patrimoniaux de celle-ci. » Art. 425 CC.
La formation est accessible à tous les publics : étudiants, lycéens, apprentis, demandeurs d’emploi, salariés, personnes en reconversion.
Pour les personnes en situation de handicap, la référente handicap de l’ERTS étudie, à la demande du candidat, les adaptations nécessaires pour le bon déroulement de la formation.
Durée :
1 an en alternance entre l’ERTS et le terrain professionnel
Dates :
du 25 novembre 2026 au 4 novembre 2027
Lieu : Olivet
Objectifs de la formation
La formation permettra au candidat de :
- Acquérir une culture et un savoir-faire professionnels et maîtriser les fondements de l’intervention tutélaire conformément à la législation en vigueur,
- Mettre en œuvre une gestion administrative, budgétaire, fiscale et patrimoniale efficace et adaptée aux intérêts et aux besoins de la personne, dans le respect de ses droits,
- Connaître, repérer et comprendre les capacités et les limites d’autonomie de la personne protégée,
- Inscrire l’intervention du mandataire dans une approche globale de la personne et de son environnement (familial, social, culturel).
Contenus de la formation
Formation théorique : 300 heures – réparties en 4 domaines de formation
- DF1. Juridique : 84 H
- DF2. Gestion : 78 H
- DF3. Protection de la personne : 72 H
- DF4. Le mandataire judiciaire à la protection des majeurs : 66 H
Formation pratique : 350 heures
Stage de 10 semaines consécutives auprès d’une personne physique ou d’un service inscrit sur les listes départementales pour l’exercice des mesures correspondant à la formation complémentaire suivie.
Dispenses et Allègements
Le candidat peut faire une demande d’allègement et/ou dispense lors de son inscription en formation selon ses acquis de formation et son expérience professionnelle.
Certains diplômes donnent droit à des allégements de formation voire des dispenses de certification.
D’autres situations permettent de bénéficier d’un allègement de formation après un positionnement de la commission d’allègement et dispense de l’ERTS dans la limite d’un tiers de la durée de la formation.

Modalités pédagogiques
Interventions magistrales, exercices, cas pratiques, mises en situation, groupes d’analyse de la pratique, apport méthodologique et accompagnement en vue de la rédaction de l’écrit final…
La formation est dispensée en présentiel mais des temps à distance peuvent être organisés ponctuellement.
Types d’intervenants
Formateurs, universitaires et professionnels titulaires de diplômes professionnels des différents secteurs du travail social…
Les candidats doivent posséder un diplôme ou titre enregistré au niveau 5 (anciennement niveau III) du répertoire national des certifications professionnelles ou justifier d’une ancienneté d’au moins trois ans dans un emploi exigeant normalement un diplôme ou titre de ce niveau.
L’admission et le parcours de formation complémentaires sont définis à partir :
- de l’étude du dossier de candidature ;
- d’un entretien de positionnement d’une durée maximale de 30 minutes, sur la base du dossier de candidature et de la grille destinée à préciser le parcours professionnel du candidat et sa (ses) demande(s) de dispense(s) ou d’allègement(s),
- d’une note technique du jury ayant conduit l’entretien à destination de la Commission d’Admission : compte rendu de l’entretien avec le candidat et définition des parcours de formation individualisés.

La formation est sanctionnée par le Certificat National de Compétences Mandataire Judicaire à la Protection des Majeurs enregistré au Répertoire Spécifique RS5622 en date du 01/01/2022 (échéance de l’enregistrement 31/12/2026).
Si les acquis sont évalués tout au long de la formation, La certification s’obtient par la validation des 4 domaines de formation prévus dans le référentiel de certification. Les épreuves de certification sont organisées par l’ERTS.
Certificateur : Ministère chargé de la Solidarité.
Le financement de la formation peut être pris en charge par le :
- CPF (Compte personnel de formation) pour les salariés et les demandeurs d’emploi
- CPF de transition professionnelle pour les salariés
- OPCO – Plan de Développement des Compétences pour les salariés
- France Travail pour les demandeurs d’emploi (sous conditions)
Après l’obtention du certificat le Mandataire Judiciaire à la protection des Majeurs peut exercer dans différents lieux d’intervention et en indépendant.
Il est également possible de poursuivre ses études vers un autre diplôme du travail social ou vers un cursus universitaire. Pour plus d’informations, consultez le site internet de l’ERTS.
